    Acquittal a ‘Much Better Outcome’ for Trump in the Senate


    Cruz pushed back against the notion there would be a dismissal, saying there would be an acquittal in the Senate rather than a dismissal because acquittal means there is a not guilty verdict reached.

    “I think the outcome of this case will not be dismissal,” Cruz told host Bill Hemmer. “It will be an acquittal. Those are different outcomes. Dismissal throws the case out without reaching a verdict.

    We’re going to reach a verdict, and the verdict is going to be acquittal, the verdict is going to be not guilty because, on the face of it, the articles of impeachment don’t meet the constitutional standard.”

    Trump administration violated the law by withholding Ukraine aid, Government Accountability Office says


    The government watchdog found that the money was withheld "for a policy reason, which is not permitted under the Impoundment Control Act."






    The Trump administration violated the law by withholding military aid to Ukraine, the U.S. Government Accountability Office said in a decision released Thursday.


    "In the summer of 2019, the Office of Management and Budget (OMB) withheld from obligation funds appropriated to the Department of Defense (DOD) for security assistance to Ukraine," the non-partisan government watchdog's ruling said.


    "Faithful execution of the law does not permit the president to substitute his own policy priorities for those that Congress has enacted into law. OMB withheld funds for a policy reason, which is not permitted under the Impoundment Control Act (ICA). The withholding was not a programmatic delay. Therefore, we conclude that OMB violated the ICA."

    An appropriations act is a law like any other; therefore, unless Congress has enacted a law providing otherwise, the president must take care to ensure that appropriations are prudently obligated during their period of availability," the decision says.


    "The Constitution grants the president no unilateral authority to withhold funds from obligation."


    If the White House wanted to withhold the funds, the president had an obligation to notify Congress and "provide detailed and specific reasoning to justify the withholding," the decision said.


    An OMB spokesperson said in response, "We disagree with GAO's opinion. OMB uses its apportionment authority to ensure taxpayer dollars are properly spent consistent with the president's priorities and with the law."


    A senior administration official said the GAO's findings "are a pretty clear overreach as they attempt to insert themselves into the media’s controversy of the day" and predicted the agency would have to reverse itself.

    Florida Senate Committee Passes GOP-Backed Universal Background Check Bill



    Florida now officially has a Republican-backed universal background check bill in play.


    Sen. Tom Lee of the Senate’s Committee on Infrastructure and Security brought up SPB 7028 yesterday. The committee is made up of eight members, five Republicans and three Democrats. The committee voted unanimously for SPB 7028 and passed the proposal except for one Senator who walked out, making it an official bill.


    I was unable to attend in person due to pressing family issues, but the NRA was there, represented by Marion Hammer. Moms Demand Action members were there, too.

    This bill is Senate President Galvano’s pride and joy. As I noted earlier, Sen. Galvano tasked Sen. Tom Lee to look at ways to “stop mass shootings.” This is the result.


    It started as a proposed committee bill. That means it wasn’t introduced by a single Senator and instead was the creation of the committee itself. The glossary of the FL State Senate states a proposed committee bill is a “proposal that may represent a mandated review, repeal scheduled by law, or, with the Senate President’s prior approval, an additional subject of broad committee significance as determined by the committee chair. When the idea is expanded, is drafted in bill form, receives a favorable vote by the committee, and is filed, it becomes a bill.

    The Government Accountability Office issued a legal opinion on Thursday saying the Trump Administration did not give US tax-payer dollars to corrupt Ukraine fast enough.

    The GAO just happened to release their report on Thursday morning to help Democrats and Nancy Pelosi.

    The Government Accountability Office issued a legal opinion on Thursday saying that President Trump’s administration broke the law by withholding defense aid to Ukraine — the issue at the heart of the president’s impeachment trial.


    That money — $214 million which had been allocated to the Department of Defense for security assistance — was appropriated by Congress and therefore the administration did not have the right to hold the money just back because it disagreed with its allocation, the opinion from the nonpartisan government watchdog said.


    “Faithful execution of the law does not permit the President to substitute his own policy priorities for those that Congress has enacted into law,” the opinion said. “OMB withheld funds for a policy reason … not a programmatic delay.
